'Contract carriage' Definition Should Include Three-Wheelers: IAMAI to MoRTH
The Internet and Mobile Association of India (IAMAI) made a submission to the Union Ministry of Road Transport and Highways (MoRTH) on the Proposed Draft Amendments to the Motor Vehicles Act, 1988. IAMAI suggested three-wheeled motor vehicles to be added under the definition of contract carriages to avoid any ambiguity. This is required in view of the change in the definition of 'motor cab' and the addition of the definition of three-wheeled motor vehicle in the draft. The submission also suggested waving the requirement of any separate commercial driving license for Non-Transport and Transport for the LMV 1 category to mitigate disruption of livelihood of marginal workers as LMV 1 covers vehicles that are used by gig workers for providing transportation services.

IAMAI Submission on TRAI Consultation Paper on Review of the Telecom Commercial Communications Customer Preference Regulations, 2018
IAMAI made a submission to the Telecom Regulatory Authority of India (TRAI) on the Review of the Telecom Commercial Customer Preference Regulations, 2018. The submission highlighted that allowing customers to de-register from receiving the transactional messages while they continued to receive services from the sender would be detrimental to the customers since customers would not be able to receive relevant updates about their services, leading to disputes between the sender and the customer. Regarding the definition of promotional calls, IAMAI pointed out that it should not cover existing consumers or users who had provided their information.

IAMAI also proposed that 'Principal Entities' (PE) be allowed to capture an authenticated digital consent from the end customer on its website at the time of interaction initiated by the end consumer, which would be in harmony with DPDPA 2023. The submission said that the current prefix for the identification of Access Provider did not provide any value to the user of that data and suggested the name of the calling PE be displayed on the end-customer's mobile and international incoming messages be allowed to contain alphanumeric headers in the interest of user safety and security.

IAMAI & IBDF Raise Concerns on Draft Cigarette and Other Tobacco Products Amendment Rules 2024
IAMAI and the Indian Broadcasting and Digital Foundation (IBDF) made a joint submission to the Ministry of Information & Broadcasting (MIB) and the Union Ministry of Health & Family Welfare (MHFW) on the Draft Cigarette and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Amendment Rules 2024 ("Proposed 2024 Amendments"). In the submission and during a subsequent meeting with the MIB Secretary Shri Sanjay Jaju the industry bodies highlighted concerns about the practicality, legitimacy, and implications of the proposed 2024 amendments. The submission underlined the uniqueness of online curated content publishers (OCCP) platforms, which were pull-based libraries and primarily accessed on small mobile phone screens.

It was also pointed out that the proposed mandates to insert non-skippable anti-tobacco health advisories when the viewer/user opens an OCCP's platform, and thereafter each time they start a program, would significantly add to viewer frustration. Additionally, such platform warnings might expose minors or other vulnerable groups to depictions of tobacco use which they would not otherwise have encountered.
