Shri Amitabh Kant Speaks on Ease of Doing Business at "We Made in India – 2024"

Shri Amitabh Kant, India’s G20 Sherpa and former CEO NITI Aayog spoke on how simplification of regulations and the enhancement of the ease of doing business had resulted in thriving entrepreneurship over the past decade, delivering the keynote address at a symposium titled ‘We Made in India – 2024’, on April 18, in Mumbai. The symposium was organised by Liqvd Asia and Demostar, in association with the Internet and Mobile Association of India (IAMAI). Shri Kant also held a separate meeting with several founders and co-founders present at the event. Playing the usual role of a problem-solver for Indian start-ups, he took note of the challenges they faced pertaining to enhancing the ease of doing business and promised to resolve the issues raised by the industry captains in a time-bound manner.

IAMAI Submission to TRAI on National Broadcasting Policy
The Internet and Mobile Association of India (IAMAI), with inputs from its Digital Entertainment Committee and the Digital Gaming Committee made a submission to the Telecom Regulatory Authority of India (TRAI) on the National Broadcasting Policy (NBP). One of the key suggestions of the submission is that the current grievance redressal mechanism for OCCP is working well and there is no need for a policy/regulatory overhaul. Instead, the focus should be on enforcing existing regulatory framework. The submission underlined that prescriptive measures or strategies would prevent the NBP from being a future-proof policy.

IAMAI also urged TRAI to clarify that the scope of this policy was restricted to the broadcasting segment considering the fundamental differences between OTT services and broadcasting services. It was suggested that Broadcasting content and carriage required distinct policy attention under the NBP and there was no need for a single regulator for content and carriage. Further, TRAI should recommend deregulation of broadcasting as the underlying principles in the NBP to limit the scope of regulation to only those aspects which cannot be addressed through market/competitive forces.
 
 
Inclusion of Gig workers Under the Minimum Wages Act Not Appropriate: IAMAI to Jharkhand Govt
IAMAI made a submission to Department of Labour, Employment, Training and Skill Development, Government of Jharkhand regarding the proposed fixation of minimum wages for gig & platform workers and their inclusion in Schedule Employment under the Minimum Wages Act, 1948. In its submission, IAMAI argued that the inclusion of gig workers under the Minimum Wages Act would not be appropriate. The submission underscored the differences between platform work and traditional employment, highlighting that the former existed as a work arrangement outside of a traditional employer-employee relationship. While IAMAI welcomed the intent of the Government of Jharkhand to work towards the welfare of platform-based gig workers, it emphasised that regulating platform work akin to traditional forms of employment could have wide-ranging consequences detrimental to the state's economy.

With respect to the inclusion of gig and platform workers under the Minimum Wages Act, 1948 (MWA), IAMAI noted that the objective of the MWA was to provide for "fixing minimum wares of wages in certain employments", where "employment" under the Act required the existence of: (i) an employment relationship; (ii) an employer; (iii) an employee; and (iv) wages for it to fall within the purview of this Act. The Submission reaffirmed IAMAI’s commitment to addressing concerns stemming from the platform economy in a manner beneficial for the continued growth of gig workers as well as platforms.
 
 
IAMAI Assures MoHFW on Industry Appropriately Alerting OTT Viewers of the Risks of Tobacco Consumption
Members of IAMAI's Digital Entertainment Committee present at a consultative meeting assured the Ministry of Health and Family Welfare (MoHFW) Additional Secretary that the stakeholders were empathetic towards the overall goal of reducing harms relating to tobacco consumption and had already started working on introducing various measures such as content descriptors, disclaimers and access controls thereby alerting the OTT viewers of the risks associated with tobacco consumption. The meeting was convened to discuss the implementation of Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Amendment Rules, 2023 (COTPA Rules, 2023). During the meeting, the Deputy Director, Ministry of Information & Broadcasting, pointed out that the Ministry of Law & Justice should give clarity on the distinction between depiction and promotion of tobacco or tobacco products, to the Additional Secretary agreed.
 
 
IAMAI Meeting with IRCTC on Key OTA Issues
IAMAI discussed a host of issues including providing real-time access to OTAs for Tatkal bookings, allowing new user registration flow, and allowing Unreserved Ticketing System (UTS) booking through OTAs, with the IRCTC Group General Manager at a meeting on April 3, 2024. IAMAI was informed that the IRCTC team was working on upgrading the tech infrastructure and tatkal software by integrating AI/ML to resolve issues. The IRCTC advised IAMAI to reach out to the Passenger Marketing Department in the Ministry of Railways for providing real-time access to OTAs for Tatkal bookings. IAMAI was also requested to submit a letter with industry data on the percentage of loss in new user registrations and dropouts on OTA platforms, so that the issue could be taken into consideration.
 
 
FCC's Lending Committee Representation to IBBI Highlights Concerns Over Reporting Unsecured Loans
The Lending Committee of the Fintech Convergence Council (FCC) made a representation to the Insolvency and Bankruptcy Board of India (IBBI) to address challenges faced by financial creditors in reporting unsecured loans to Information Utilities (IUs) under IBBI regulations. It highlighted concerns regarding the costs and complexities associated with reporting small ticket size loans and requested clarifications and relief measures from the IBBI. Proposed solutions included a threshold-based fee structure and revisiting authentication processes for borrowers.
 
 
FCC's Lending Committee Urges RBI to Simplify KYC Requirements for MSMEs
The Lending Committee of the Fintech Convergence Council (FCC) made a representation to the Reserve Bank of India (RBI) on the significance of MSMEs in the Indian economy and the challenges they face in accessing credit due to Know Your Customer (KYC) requirements. The representation proposed several solutions to the RBI on the issue, such as simplifying KYC processes for MSMEs through tier-based KYC, streamlining procedures for MSMEs with existing bank accounts, online verification of KYC documents, using secondary data for address verification, and enhancing the Video-Customer Identification Process (V-CIP).
 
 
FCC's Investment Committee Urges SEBI to Extend Deadline on PAN Verification
The Investment Committee of the Fintech Convergence Council made a representation to SEBI addressing concerns of the Mutual Funds (MF) industry regarding the recent directive by the Central Board of Direct Taxes (CBDT) to implement a new system of PAN verification by April 30, 2024. It underlined the challenges faced by the industry in matching customer details such as name and date of birth with their PAN records. The representation suggested extending the deadline by one year for adopting the revised process and emphasized the potential negative impact on investor experience and industry growth if the new system was rushed. It also proposed alternative solutions, such as linking PAN with Aadhaar and implementing OTP-based verification, to enhance security while maintaining investor convenience.
 
 
FCC's RegTech Committee Organises Knowledge Session on 2023 Industry Perspectives Report
The Regtech Committee of the Fintech Convergence Council (FCC) organised a virtual knowledge session on April 4, 2024. The guest speaker was Deborah Young, Founding CEO, The RegTech Association. The webinar discussed the recently published "2023 Industry Perspectives Report", providing insights into the evolving landscape of the RegTech industry. Over 60 industry professionals participated in the session.
 
 
Prepaid Payment Instrument Committee Meeting
The Payments Council of India (PCI) facilitated the quarterly meeting of its Prepaid Payment Instrument (PPI) committee. The discussion focused on various aspects of the PPI ecosystem, including the Graded KYC proposition, alternative methods of authentication, loading charges for PPIs, PIN integration in interoperable PPI transactions on UPI, and exploring subsidies for PPIs like UPI transactions.
 
 
PCI, FCC Webinar on Regulation on Payment Aggregators- PA-O & PA-P
The Payments Council of India (PCI) and the Fintech Convergence Council (FCC), in collaboration with PwC, held a webinar to discuss the newly published draft circular on "Regulation of Aggregator - Physical Point of Sales (PA-P) and Amendments of Payment Aggregators - Online (PA-O)". The webinar covered important issues for payment aggregators, including merchant onboarding procedures, due diligence requirements, and the net worth criteria for participation.
 
 
Discussion on Lien Marking and Freezing of Accounts Due to Fraud
The Merchant Aggregator and Acquirers Committee of the Payments Council of India (PCI) organized a discussion about business correspondent accounts being frozen due to fraud. During the meeting members sought legal guidance and discussed creating SOPs for handling such issues.
