Submission on IT Rules, 2021 Draft Amendments
IAMAI made a submission to the Ministry of Electronics and Information Technology (MeitY) on the draft amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 on July 6 2022. The proposed amendments would significantly increase compliance and operational costs for small companies. This appears to go against the stated intention of the government to protect smaller companies and start-ups. IAMAI also proposed self-regulation for intermediaries to deal with issues pertaining to content moderation.
 
 
Submission on Delhi Motor Vehicles Aggregator Scheme, 2022
IAMAI made a submission to the Transport Department, Government of the National Capital Territory of Delhi on the Draft Motor Vehicles Aggregators Scheme, 2022. IAMAI welcomed the modification made by the Transport Department to increase the license validity period from one year (in the previous draft scheme) to three years (in the latest draft scheme. The mandated fleet conversion targets set for aggregators were too steep, and IAMAI humbly requested that the mandated numbers and timeframes be relooked. IAMAI also suggested that a pilot study be undertaken between GNCTD and industry members, to gauge conversation levels in a year. Uncertainties regarding legal compliances mandated by the policy were also highlighted, and IAMAI requested the Government to issue clarifications on the same.
 
 
Submission of Standardized Icons Draft to RBI
Payments Council of India (PCI) and a working group comprising members from Jupiter Money, Fampay, Amazon, Setu, PayU, Eko, Paytm, SafexPay, Mobikwik and WhatsApp Pay as well as teams from the SBI, HDFC, PNB, Visa and NPCI prepared the final draft of the icons which has been submitted to RBI. A meeting with the CGM, Department of Payment and Settlement Systems (DPSS) is being scheduled to discuss the way forward and implementation roadmap for the industry.
 
 
Representation to RBI on Geo Tagging of Transactions
PCI made a representation to RBI on the geo tagging of transactions. The representation was made pursuant to the Monetary Policy Statement 2020-21 dated October 08, 2021, on the framework for geo-tagging of physical payment acceptance infrastructure prescribed by RBI.
 
 
Logistics Tech Committee Meeting With Senior Railways Officials
A delegation of the IAMAI Supply Chain and Logistics Tech Committee met with Shri Amit Kumar Jain, General Manager, CRIS, Indian Railway Traffic Service (IRTS) and Shri Manoj Kumar Srivastava, Principal Executive Director, Traffic Transportation, IRTS at Rail Bhawan, Delhi, on July 19, 2022. The delegation, led by Mr Rajkiran Kanagala (Chair) and Mr Varun Parihar (Co-Chair) of the committee, apprised the Indian Railways officials about the activities of the committee. The forthcoming virtual Railways aggregation platform initiative was also discussed at the meeting. Under this initiative, Indian Railways is to allow- private logistics service providers to book cargo for scheduled trains between destinations. The entire process will be online with 50 percent advance, and rebates will be offered on roundtrip bookings. While Indian Railways doesn't provide first-mile / last-mile services, the online platform will host empanelled private aggregators for first mile/ last mile servicing, the officials told the committee. The Committee will continue its engagement with the railway officials to help develop this project with a larger representation from the logistics industry including committee members.

HealthTech Committee Meeting with Joint Secretary, MoHFW
IAMAI HealthTech Committee members met up with Shri Lav Agarwal, Joint Secretary, Ministry of Health and Family Welfare (MoHFW) on July 19, 2022 at Nirman Bhawan, New Delhi to discuss various industry issues and collaboration-opportunities in the digital healthcare sector. Key issues which came up for discussion were:
  • Digital healthcare sector collaboration with MoHFW to further improve access, affordability and quality of healthcare for all.
  • Seeking guidance from the government on the way forward for the digital healthcare sector.
  • Updates on the latest developments in the digital healthcare sector, e-pharmacy rules and telemedicine guidelines.
 
 
HealthTech Committee Meeting With EMRB Member
IAMAI HealthTech Committee members met Dr. Yogender Malik, Member, Ethics and Medical Registration Board (EMRB), National Medical Commission on July 29, 2022 at the National Medical Commission (NMC) Headquarters. The meeting broadly discussed the recommendations made by IAMAI on the National Medical Commission's Registered Medical Practitioner (Professional Conduct) Draft Regulations, 2022.
Following are the highlights of the discussion:
  • Online-Offline Parity:When it comes to ethical conduct or exercising of professional judgement of Doctors, there should be no artificial segregation of expectations for online vs offline interactions.
  • Alignment with Other prevailing Acts/ Laws:While some parts of the draft regulations seem to cover certain dimensions already adequately covered by separate acts, some of them are not aligned with the prevailing acts.
  • Business Model: The legitimate financial relationship between the RMPs and institutions should be allowed rather than putting a blanket ban under commission/splitting of fees. Similarly, intermediaries play a role in patient assistance, medical tourism and other related fields, which need to be encouraged and regulated properly, rather than enforcing a blanket ban.
 
 
FCC Submission to SEBI
Members of the Fintech Convergence Council's Wealth Management / Investment Committee responded to a Security and Exchange Board of India (SEBI) circular on nomination for mutual fund unit holders, in order to seek clarity on certain clauses of the circular. A submission was made in this regard to Shri Bithin Mahanta, General Manager, SEBI. The representation pointed out some of the operational challenges that the industry might face in the implementation of the circular.

Report Launch on IT Rules, 2021
IAMAI and The Dialogue held a panel discussion and report-launch on July 4, 2022. The report titled 'IT Rules, 2021:A Regulatory Impact Assessment Study' was released at the programme. Dr. Amar Patnaik, Member of Parliament (Rajya Sabha), Dr. Aruna Sharma, Former Secretary, Ministry of Electronics & IT, Govt. of India, Mr. Rajat Garg, Founder, MyUpchar and Ms. Megha Bhatia, Founder, Our Voix (a child safety NGO), took part in a panel discussion.

Among other things the findings of the report point out that the IT Rules, 2021, though intended to create a robust regime for tackling the modern-day challenges of ensuring safety online by curbing the proliferation of disinformation, child sexual abuse material, seditious and terrorism related content, have raised questions around the legal and technical legitimacy and viability of many of the provisions they entail. The report found that over 96% of the intermediaries surveyed believed that the additional due diligence mandates imposed by the rules would lead to overwhelming economic repercussions and negatively impact their ease of doing business.

Webinar on GIFT City Regulations
The IAMAI Venture Capital (VC) Committee organized a virtual question-and-answer session with Mr. Kalpesh Jain, Managing Director & CFO at Multiples Equity on July 7, 2022. The webinar was held to disseminate information on setting up an Alternative Investment Fund (AIF) in the Gujarat International Finance Tec-City (GIFT City), related processes and regulations. The session was attended by representatives from more than funds.

IAMAI organized a SaaS Founders' Meet in Bengaluru on July 15, 2022. The event included a panel discussion followed by a networking session. Mr. Manoranjan Indugam, Co-Founder appEQ.ai, Mr. Srikrishna Swaminathan, C0-Founder, Factors.ai and Mr. Nikunj Thakur, Product Manager, Whatfix shared their experiences and insights on the overall SaaS landscape, challenges and opportunities before start-ups, team-building and SaaS marketing.
 
 
GFF Pre-event:Fintech Founders Meet in Bengaluru
FCC and PCI in collaboration with eChai organized a Fintech Founders' Meet in Bengaluru on July 22, 2022 as part of the pre-event series to the Global Fintech Fest 2022 (GFF 2022). The meet included a panel discussion followed by a networking session. The panellists were Mr. Ankur Pandey, Co-Founder, Signzy, Mr. Vineet Saxena, Co-Founder, Card91, Mr. Nataraj Choudhury, CTO, Zolve, and Mr. Rajeev Agrawal, Founder & CEO, Innoviti. Issues addressed by the four speakers included opportunities in fintech, how to build and sell fintech products and regulations impacting fintech business. BNPP Sub-committee Meeting
The Digital Advertising Council's Billing and Payment Process (BNPP) Subcommittee conducted the monthly meeting of IAMAI and Advertising Agencies Association of India (AAAI) members on July 1, 2022. The key agenda of the meeting was to clear outstanding payments to publishers. The meeting was hosted virtually.
 
 
Meeting of Sub-Group on New Age Model in Surgical Care
The second meeting of the HealthTech Committee Sub-Group on New Age Model in Surgical Care was held on July 29, 2022 in Gurugram. The meeting of the Sub-Group was convened to discuss the challenges to the sector. The issue of push back from insurance providers was one of the key points of discussion. Preparational details for the launch of a report titled "The Patient`s Experience of Surgical Care in India" was also discussed.
