Submission to Ministry of Labour and Employment on Definition of 'Aggregator'
The Internet and Mobile Association of India (IAMAI) made a submission to the Ministry of Labour and Employment regarding the definition of 'aggregator' in the Code on Social Security, 2020 (CoSS). In the CoSS, 'aggregator' has been defined as "a digital intermediary or a marketplace for a buyer or user of a service to connect with the seller or the service provider". IAMAI in its submission noted, a strict interpretation of this definition would suggest that third parties who engage gig and platform workers, for the purpose of provision of services to digital intermediaries or marketplaces, are not included in the definition of 'aggregators'. Such an interpretation may impact a significant share of gig economy workers and leave them out of the intended outcome, which IAMAI contended was not the intent of the CoSS. In view of this, IAMAI requested the Ministry of Labour and Employment to add a clarification in the rules proposed to be finalised under the CoSS, stating that third-party service providers (and their sub-contractors), engaged by digital intermediaries and marketplaces should also be considered as aggregators.
 
 
Submission to Ministry of Road Transport and Highways on Motor Vehicle Aggregator Guidelines, 2020
Following participation in a stakeholder consultation on the Motor Vehicle Aggregator Guidelines, 2020, hosted by the Ministry of Road Transport and Highways (MoRTH), IAMAI made a submission to MoRTH putting forth several suggestions on the Aggregator Guidelines.

IAMAI recommended a slew of changes to the Aggregator Guidelines addressing clauses pertaining to vehicle licenses, data storage and processing, social security, and police verification. The submission underlined the need to ensure through the clauses that states issued reasonable conditions for operating non-transport vehicles and refrained from prohibiting the operation of non-transport vehicles where possible. IAMAI also requested the MoRTH to clarify that the Aggregator Guidelines do not apply to platforms merely facilitating the sale of tickets for transport services.
 
 
FCC's Bureau Committee Representation to RBI on Compliance Issues Related to CIC and DPDPA
The Bureau committee, which functions under the Fintech Convergence Council (FCC), made a representation to the Reserve Bank of India (RBI), regarding compliance issues with respect to the Credit Information Companies (Regulation) Act, 2005 (CIC Act), and the Digital Personal Data Protection Act, 2023 (DPDPA). The representation emphasised the crucial role of CICs in India's financial landscape in ensuring data-backed lending decisions. The submission pointed out the conflict between CIC's existing robust data processing/consent framework and the recently released provisions under DPDPA, and requested clarification in this regard as CICs will have to make major changes in existing processes to adapt to the DPDPA provisions.
 
 
Voluntary Code of Ethics for Online Gaming Industries Launched at Indian Gaming Convention Held in New Delhi

The Internet and Mobile Association of India (IAMAI), in collaboration with the Federation of Indian Fantasy Sports (FIFS) and the E-Gaming Federation (EGF) organised the first edition of the nation's largest gaming conference, the Indian Gaming Convention (IGC), on December 5, 2023, in New Delhi. The highlight of the convention was the launching of the 'Voluntary Code of Ethics for Online Gaming Industries'. Curated by IAMAI, the 'Voluntary Code of Ethics' was signed by the FIFS, the EGF and the All India Gaming Federation (AIGF), as a 'joint declaration of intent' to commit to building a safe, trusted, and accountable digital gaming industry with a focus on user protection.

Shri Rajeev Chandrasekhar, Union Minister of State for Skill Development and Entrepreneurship and Electronics and Information Technology, addressed the IGC through a written message. Over a plethora of sessions industry leaders discussed public policy imperatives, regulatory frameworks, and the role of the online gaming industry in fuelling digital india's growth.

Two reports were also launched at the IGC: Ernst & Young (EY) published a report titled 'New Frontiers: Navigating the Evolving Landscape of Online Gaming Industry', and a report titled 'Regulatory Roadmap for Online Real Money Gaming,' was published by Parinam Law Associates.

The IAMAI Digital Transformation Committee, in collaboration with Salesforce, organised a roundtable discussion on December 6, 2023, in Mumbai. Broadly, speakers at the roundtable explored the evolving Indian financial landscape. The theme of the roundtable was Data to Destiny: Unleashing Finance's Potential'.

Masterclass on DPDP and its Impact Across Fintech Ecosystem:
IAMAI’s Fintech Convergence Council (FCC) and the Payments Council of India (PCI) held an exclusive virtual masterclass focusing on the Digital Personal Data Protection Act (DPDP Act) and its implications on fintech, on December 12, 2023. The session was conducted by industry experts Sreenidhi Srinivasan, IKIGAI Partner, Data, and Aparajita Srivastava, IKIGAI, Partner, Product and Fintech. Over 130 industry professionals joined the webinar.
